Employers can enjoy their summer vacation a little more this year — the U.S. Equal Employment Opportunity Commission (EEOC) tentatively announced that the 2022 EEO-1 Component 1 data collection will start in Fall 2023 versus the originally anticipated July timeframe.

The EEO-1 Component 1 report is mandatory for all private-sector employers with 100 or more employees and federal contractors with 50 or more employees meeting certain criteria. The collected demographic workforce data includes data by race/ethnicity, sex and job categories.

Previously, the EEOC announced that it expected to open EEO-1 data collection in mid-July 2023. However, the EEOC is currently completing a mandatory, three-year renewal of the EEO-1 Component 1 data with the U.S. Office of Management and Budget (OMB) under the Paperwork Reduction Act (PRA), so it had to push back the data collection start date until this renewal is complete.

According to notices published in the Federal Register on November 10, 2022, and May 2, 2023, the renewal won’t change the types of demographic workforce data the EEOC has historically collected from employers — OMB approval is sought for measures that streamline and modernize how the data is collected (by, for example, providing additional self-service options, resource materials and an online support message center).

Employers should note that the 2021 EEO-1 Component 1 data collection closed on June 21, 2022, and no additional reports will be accepted. The EEO-1 Message Center is no longer accepting any requests for assistance; it will resume normal operations immediately prior to the opening of the 2022 EEO-1 data collection.

All updates about the 2022 EEO-1 Component 1 data collection will be posted on the EEO-1 Data collection website as they become available.
